Resale Price Maintenance - A Comparative American-European Perspective (Hardcover): J.Roland Pennock Resale Price Maintenance - A Comparative American-European Perspective (Hardcover)
J.Roland Pennock
R4,007 Discovery Miles 40 070 Ships in 12 - 17 working days

Resale Price Maintenance deals with selected countries: Canada, the United States of America, Sweden, Denmark, Ireland, and the United Kingdom. The main emphasis is placed on two subjects, namely, the effects of resale price maintenance and its termination, where this has taken place, as disclosed in official and private investigations; and the development of public policy measures, including consideration of the problems encountered in their implementation. B. S. Yamey, in the volume, defines the major economic issues involved in resale price maintenance and presents a compendium of arguments that have been employed in the debate on resale price maintenance. Taken together, these country studies constitute a compendium of the arguments which have been deployed in debates on resale price maintenance; all the major issues and most of the minor ones are considered or at least mentioned in one or more of the studies in the course of the review of developments in public policy. An introductory chapter, by the editor, sets the scene with an analytical discussion of the major economic issues. This volume considers the historical development of the practice of resale price maintenance and its extent and scope when at its height. It also deals with resale price maintenance in the European Common Market. Dealing with the practice in the constituent countries and also as it is affected by the emerging Common Market policy towards restraint on competition, the volume focus on developments in public policy. Resale Price Maintenance carefully examines all major and many minor issues covers a wide range of trades and products that have been affected by resale price maintenance, and provides fruitful analyses of various empirical studies that have been made on the restraint and/or advancement of commerce.

Representation (Hardcover): J.Roland Pennock Representation (Hardcover)
J.Roland Pennock
R4,159 Discovery Miles 41 590 Ships in 12 - 17 working days

This volume, offers the thought of twenty scholars on the theory, history, and practice of representation. Two developments make a new appraisal of this subject timely. One is the decision of the United States Supreme Court requiring representation to be democratic in the sense of affording every voter an equal voice in government. The other, that some governments that are not democratic in the sense of having freely competitive political parties are now nevertheless "representative." A number of essays in this volume deal with the problems of equitable apportionment of representation from the point of view of constitutional law, normative theory, and practical politics. Two take up the proposal of weighted voting as a means for meeting the Supreme Court's objectives, and two others inquire into the meaning of representation under noncompetitive party systems.Combining an overview of the subject with a detailed analysis of its various aspects, this book presents information of major significance for all engaged in the study of political processes, comparative politics, constitutional law, political theory, and legislative behavior. The general reader of politics and political and legal philosophy will find here a clear vision and explication of the theoretical and practical background and the underpinnings of representative government.J. Roland Pennock was professor of political science at Swarthmore College for more than twenty-five years, as well as a fellow at the John Simon Guggenheim Memorial Foundation.John W. Chapman is professor emeritus of political science at the University of Pittsburgh.

Coercion (Paperback): J.Roland Pennock, John W. Chapman Coercion (Paperback)
J.Roland Pennock, John W. Chapman
R1,426 Discovery Miles 14 260 Ships in 12 - 17 working days

Coercion, it seems, like poverty and prejudice, has always been with us. Political thinkers and philosophers have been arguing its more direct and personal consequences for centuries. Today, at a point in history marked by dramatic changes and challenges to the existing military, political, and social order, coercion is more at the forefront of political activity than ever before. While the modern state has no doubt freed man from some of the forms of coercion by which he has traditionally been plagued, we hear now from all sectors of society complaints about systematic coerciveness-not only on the national and international levels, but on the individual level as well.
A general overview is provided in J. Roland Pennock's introductory chapter. Four papers that are primarily definitional and concerned with usage follow this introductory chapter. Among other issues, they raise the question whether an offer, as well as a threat, may be coercive. One of these papers maintains that it may, while two other papers are opposed to this view. The last paper in this section introduces the notion that coercion relates to the use of space, and it uses this idea to distinguish coercion from both oppression and repression. The next three papers are concerned especially with the moral aspects of the subject. Following this the next three papers discuss the problem of the avoidability of coercion followed by a contribution that deals primarily with the question of whether coercion interferes with political obligation and which it states that it does not. The final three papers deal with the role of coercion in international relations. One of the papers considers coercion by means of game theory analysis, noting that a country may influence the behavior of other countries by shaping their evaluation of the results of a specific negotiation or interaction. The second analyzes bargaining tactics, and also makes use of game theory. Lastly, the concluding papers, argue that the dynamics of national and international politics are more alike than is generally supposed.
Students and scholars in political science, philosophy, and law will find this volume a timely addition to their libraries.

Political and Legal Obligation (Paperback, 1st pbk. print): J.Roland Pennock Political and Legal Obligation (Paperback, 1st pbk. print)
J.Roland Pennock
R1,478 Discovery Miles 14 780 Ships in 12 - 17 working days

At a point in history marked by dramatic challenges to the existing political and social order, the question of legal and political obligation emerges as a focal point of international concern. Amid the clamor for radical change in the established order, theories of political obligation demand renewed examination. In this volume, eighteen leading specialists in the legal, philosophical, and political science aspects of the question offer their views on this timely topic. Part I examines the nature of moral, legal, and political obligation. The first essay presents a set of definitions that denies the very existence of obligation. While the second essay disagreeing particularly with respect to the relationship of political to moral tenets, and the third discussing the highly complex interplay between law and morality. The following essay approaches obligation as existing in the context of an established political and legal system and stresses the importance of evaluating the negative consequences of challenges to the law as well as those arising from the "absence" of challenges. The next paper maintains that political obligation is so complex that its very existence depends upon rational deliberation in particular contexts. The fifth, explores four significant theories but accepts only the one based on the broadest definition of obligation. While the final essay in this part considers political obligation a unique and generalized moral obligation. Part II takes up the conditions of obligation and of obedience. The first essay in this part discusses the conditions necessary to generate a "felt obligation." The second paper, concentrates on exposing key obstacles to empirical proof that behavior is or is not motivated by "felt obligation." While the third draws upon a large body of literature and court decisions dealing with compliance to the law. The forth essay is a case study of Rome probes the role of obligation during that city's seven centuries of existence without a police force, and the ultimate breakdown of the system. Against the background of the thinking of Hobbes, Hume, Rousseau, and particularly Aristotle, the final essay in this section propounds the theory that any specific form of government has a direct bearing on the obedience of those governed. Part III highlights ethical considerations that arise out of civil disobedience. The first essay proposes a rather restrictive definition of civil disobedience, and then embarks on a surprising examination of his subject in the light of the traditional arguments for "just war." Following that a broader examination of disobedience, emphasizing a contextual approach and applying as a test the likelihood of public good that will result from disobedience is explained in the second paper. The third, points out the inadequacy of many traditional tests and definitions of civil disobedience, and warns against possible oversimplification that conceals significant issues that warrant exposition. While the forth evolves a theory that limits the obligation of alienated residents. Immediately following this the next essay explores civil disobedience in the unusual context of the totalitarian regime. In the final chapter, the essays consider the ideas and thought of Gandhi and their relevance to Western politics. Scholars and students in the areas of law, philosophy, and political science will find this volume a vital addition to their libraries..
